Grain and Hay

State law defines a roving grain buyer as a person who buys or markets grain but who does not operate a facility where grain is received. Roving grain buyers are governed by Chapter 60-02.1 of the North Dakota Century Code. As is the case with grain warehouses, roving grain buyers must provide the Commission with a performance bond that is available to help compensate valid grain claimants if the buyer becomes insolvent.

At the beginning of the biennium there were 43 licensed roving grain buyers in North Dakota. There were 44 as of June 30, 2001.

A hay buyer is a person who is in the business of buying hay from the owner for resale or processing, or who markets hay on behalf of the owner. Hay buyer activities are governed by Chapter 60-03 of the North Dakota Century Code. As of June 30, 2001, there are no licensed hay buyers in North Dakota. It was expected that the emerging hay industry might alter this situation but that has not yet been the case.
